RHONJ: Jacqueline Laurita’s Personal Exposure and Signature Apparel’s Creditors list $55 Million in Claims

The Laurita Bankruptcy has been a source of speculation since it’s inception.  Faux Reality has not addressed the Laurita financial or legal issues on The Real Housewives of New Jersey.  In reality, the Lauritas are in the middle of an incredibly ugly and combative struggle for survival.   Creditor’s of Signature Apparel (Laurita’s company) allege they are owed in excess of $55,000,000, it is further alleged that the Lauritas drained Signature Apparel of it’s assets and fraudulently diverted the funds for their personal use.

The only meaningful articles concerning Laurita’s plight have been found on StoopidHousewives who reported the filing against the Lauritas, the admissions of fraud (by letter dated July 7, 2012, Chris Laurita admitted that he was not candid with the Court regarding the termination date of the $2.8 million dollar agreement with ROC Fashion) and the continued battle.

Jacqueline Laurita has been asked about the bankruptcy on two occasions: on Watch What Happens Live and at the reunion. Both times, her response was exactly the same, a canned answer that while technically correct, is false in it’s omissions.  Jacqueline indicated that the bankruptcy is not a personal bankruptcy, it was a forced bankruptcy filed by the creditors against the company, Signature Apparel Group to recoup their money. PARTIALLY TRUE

Jacqueline failed to disclose that Signature Apparel was forced into bankruptcy based upon  allegations that, among other things, the Lauritas fraudulently diverted funds from the company for their personal use in excess of $7,000,000.  (Case No. 09-15378)

The Court was compelled to appoint a Trustee, accountants, and attorneys for the protection of the creditors.  On November 3, 2010, the Trustee filed a Complaint against Christopher Laurita, Jacqueline Laurita, Joseph Laurita, Adeline Laurita and Anthony Laurita alleging fraudulent transfers of funds and asked that the Lauritas be held accountable due to fraud, embezzlement and/or larceny. (Case No. 10-04207)

Original Complaint was Amended on March 24, 2011

The Complaint states that Signature Apparel was founded in 2005 by brothers Chris and Joseph Laurita. Shortly after it’s inception, the Laurita brothers drained Signature Apparel of

all of its funds and assets in order to support the families’ increasingly opulent lifestyle of private jets, limousines, extravagant parties, premium automobiles, designer clothing, ostentatious home furnishings and lavish vacations.

Paragraph 1 of the Amended Complaint dated March 24, 2011.

The trustee further alleged that the Lauritas sought to liquidate Signature Apparel so there would be no money for creditors.  Signature Apparel transferred a license (to sell JayZ’s clothing line) to ROC Fashions, LLC for $2.8 million dollars. According to the US Trustee, instead of placing the $2.8 million dollars in the Signature Apparel account, Chris Laurita took the funds for services he claimed he rendered to ROC Fashions. The Trustee filed a case against Roc Fashions alleging that it conspired with the Lauritas to defraud creditors. (Case No. 11-02800)

So when Jacqueline Laurita claims that the bankruptcy is not a personal bankruptcy, she fails to mention that the U.S. Trustee personally charged her, her husband, three in laws with  fraud, conversion, embezzlement, larceny etc. and filed several lawsuits against persons and entities for conspiring with the Lauritas to defraud creditors.

On March 29, 2012, Judge Beck of the US Bankruptcy Court refused to dismiss the ROC Fashions case.   Judge Beck stated that the Complaint “alleges a very unsavory relationship between Roc Fashions and the Lauritas. And it alleges aiding and abetting some very bad behavior that damage the creditors of Signature Apparel.”  Page 16 of the March 29, 2012 Transcript. Judge Peck stated that “The allegations . . .  are frankly scandalous.” When the attorney attempted to minimize the issue, the Judge stated:

[T]he Lauritas conspired with your clients to divert 2.8 million dollars away from Signature Apparel. And the fact that your clients paid 2.8 million dollars to one of the Lauritas [Chris Laurita] is an incredibly bad fact.  And you know what? The affidavit doesn’t explain it; it doesn’t. In fact, what it does is puts a bull’s eye on your clients. 2.8 million dollars? That’s a lot of money.

A Discovery Order was entered on August 13, 2012 in the lawsuit against Jacqueline Laurita and her family with the following dates:

  • Fact discovery completed by October 26, 2012
  • Expert discovery completed by February 22, 2013

What is most disturbing is the Lauritas apparently drained Signature Apparel of all it’s assets and reduced it to an empty shell, thus leaving the creditors holding “an empty bag of unpaid invoices.”  Attached is a list of some of the creditors that made up over fifty five million dollars of monies claimed to be due and owing:

  • Susan G Komen Cancer Foundation $18,000
  • Federal Express $14,300
  • American Express $$83,000
  • UPS $9,500
  • Ikon Financial $95,000
  • Artful Holdings, LLC $10,350,000
  • Studio IP Holdings, LLC $20,700,000
  • CitiGroup Commercial $200,000
  • Daihwa $456,000
  • Hitch & Trail, Inc. $3,699,000
  • Putnam Leasing $444,000
  • GiftTex: $96,000
  • Talful, LTD $4,750,000
  • Harvestway Ltd $5,051,000

It is unclear at this time if any of the aforementioned companies that were owed millions of dollars were forced to close and/or file for bankruptcy as a result of Signature Apparel’s inability and/or refusal to pay their debts.

Jacqueline Laurita needs to acknowledge the extent of her personal exposure. She seemed knowledgeable when discussing the Giudice bankruptcy, surely she knows her potential exposure where she is a named Defendant accused of fraud, embezzlement and larceny. Will she be as consumed about potential Jail Time as she was for her “friend?”

    I saw this on Twitter and couldn’t help but laugh. Why is there a double standard. When Teresa filed for bankruptcy, and the sum was enormous, people talked about how much of a crook she was, she was the scum of the earth, etc., Now Jac has a claim of bankruptcy that makes hers seem itty bitty.

    Wow. Thanks for the information. It’s really sad that Teresa gets blasted to this very day, called every ugly name in the book. Meanwhile Bravo and the public give the Lauritas a cursory glance and a shrug. Somehow the fact that it is a business bankruptcy seems benign to people. No it isn’t a tax write off. No it does not “happen all the time.” The aforementioned trite phrases do nothing to diminish the fraud and embezzlement that funded the Lauritas luxury lifestyle.How many people go to work every day and struggle to feed their kids and pay their bids while wondering what they are doing wrong. Apparently the key to living like a millionaire is to be unencumbered by conscience or a sense of responsibility. Looking on Chris Laurita quietly imparting his moral judgements on the Guidice’s financial failings. Really Chris? Really. The irony is rich indeed,

      Briteyes32: If you use your little magnifying glass you can read the pertinent information (Case No. , dates, page numbers, etc.) about this filing and then look it up yourself if you think any part of this is “made up.” Please. You may learn something. It’s people like you who believe any of these HW shows are “reality tv,” yet question actual facts staring you right in the face.

      The Komen foundation is suing them.. you know, that hole in the wall charity that supports finding a cure for breast cancer. The Komen foundation is probably one of the most visible charitable organizations in the world, so if they are making a claim… I feel that it lends legitimacy to the other claims.

      The problem with white collar crime is that it doesn’t feel like crime… it feels more like creative bookkeeping. But… it is definitely a criminal act to not pay your creditors while funneling money into personal accounts and using business accounts for personal use. I, for one, am sick of the psuedo-rich (or the flat-out rich) pickpocketing money from others.

Also, remember this past season Chris saying he would have helped the Giudices with their money problems and bought their furniture, etc. and given it back?? I guess we know where the money to help them out would have been coming from…

    Does anybody know if Chris L. funded the BLK Water Project with this “diverted” money? I remember when Albie said in his video diary that he and Christopher would have to take that business seriously because their uncle “put up the money for it”.
    Hmmm, now that I think about it I’m also wondering if it was Caroline’s brother Chris who really purchased that Jaguar lease for her, and not old man Manzo. (Note: the indictment mentions a Jag or maybe two). How much did the Manzo’s know about these felonious acts and could they have been aiding and abetting do ya think? Can anyone on this blog “in the know” find out? It would be interesting to say the least.

    Thank god the Guidices are working hard to “right their wrong”. The rest of the cast are not above the law and I can hardly wait for February 2013 when the experts finish investigating the 58 or so items of Discovery. I also especially thank web sites like this and the Fame Whorga’s who can debate the other side of the story backed with fact finding. Geeze before I found you all I thought I was going dingy for going against popular opinion – not believing any other cast members and always feeling supportive for Teresa, being the underdog. The tables should turn come the end of next season, but I hope no one puts a gun to themselves or someone else in the meantime.

    • i worry about gia, i know teresa protects her as much as she can against watching the show. but how much does she see at friends homes. caroline and the rest calling her mother crazy and all kinds of names, seeing them bring the gossip papers with headlines accidently showing. then lauren has nerve to talk to teresa about sucide.well lauren, keep your mouth shut, my son just lost his 14 yr old to sucide and you,andy,rest of your crowd could be driving gia to it. but then you’ll twist it to make it all teresa’s fault with your phoney tears.

    As a bc survivor, the rip-off, alledgedly, of the Susan G. Komen org caught my eye. Does anyone have more specifics about this? How does one rip them off, maybe using their name to sell products without their consent or what? I have always liked Chris on the show and that may change my mind.

      I was also wondering about that one, Barbara. If I had to guess, I would say that Chris sold clothing items with the pink ribbon and didn’t pay the Komen foundation their share. When you buy items with the ribbon, it always says that a portion of the profit on that item will benefit Komen. I guess Chris forgot to send them a check (scumbag). And now Jac wants to involve herself with Autism charities???? Pulease…

      They sold t shirts of which the Susan G. Komen foundation was to receive a royalty as their logo on the shirts was the reason for selling the shirts in the first place. So it’s really a double hideous fraud, since the people who bought the shirts meant to do so for altruistic reasons and thought they were aiding a very important cause. and then the royalties due to the foundation were never turned over , hence their lawsuit against the Lauritas. Possibly why the judge considered the case to be “scandalous fraud.” Wise up about Chris. He’s a schemer.

    What they mean by “Discovery Facts due Oct. 26, 2012″ is that the Prosecutor/Attorney has to have the “Discovery of Facts” (documentation of proof, witnesses, receipts, etc..) to all attorneys involved and filed with the court by that date. “Discovery’s” are the documents due by the attorneys. I work on Discovery’s daily.

    Keep in mind, for any of you doubting this story (and thanks to the Blogger of this site and to Stoopid Housewives) if it’s gone this far into Discovery’s, there is a real case here that is pretty serious against the Laurita’s. And for JackoWacko to shrug it off as if it’s some sort of conspiracy against them insults all of our intelligence.

    These people are in A LOT of trouble if found guilty of the accusations. If there are Trustees & accountants involved in the investigating-PHEW-it’s NOT a pretty scenerio.
